South Australia Raises Retail Lease Threshold to $420,000

Changes expand protections for more tenants from July 2025

The South Australian government has confirmed that, from 1 July 2025, the annual rent threshold under the Retail and Commercial Leases Act 1995 will increase from $400,000 to $420,000. This adjustment brings more leases into the scope of the Act, giving additional tenants access to statutory protections around disclosure, rent reviews, and dispute resolution.

Why it matters for businesses:

Tenants in this higher rent bracket may now have stronger rights when negotiating fit-out works, refurbishments, or defit obligations at the end of a lease. Understanding these legal changes is essential for landlords and service providers managing retail projects.
